Restraining Order Vacated After Hearing in Brockton District Court

Client sought Kristin’s representation as the defendant in a restraining order hearing at Brockton District Court. The mother of his child had obtained a temporary restraining order against client based upon her false allegations of threatening phone calls. After Kristin showed the judge that the plaintiff was likely motivated by a desire to gain leverage in a custody dispute (not motivated by actual fear of my client) and after Kristin argued that the alleged conduct – even if true – would not place a reasonable person in fear of imminent bodily injury, Judge Carroll refused to extend the restraining order.
